It doesn't have to be commercial, which prevents spamming jerkwads like this from pretending they're innocent because they haven't sent the sales message. (Yet.).

Many messages are so wildly over-duplicated and submitted by the new suckers in sales pyramid schemes that they easily exceed the most generous guidelines for avoiding spam. The multitudinous fraudulent "see my diabetes cure!" scams definitely fit that bill, even if the individual message wording changes.
